WellXS Mobile Application Terms & Conditions of Use

1. Acceptance of Terms

By downloading, accessing, or using the AksesCare Sdn. Bhd. (“AksesCare” or “the Site”) WellXS mobile application (“WellXS” or “the App”), you agree to be bound by these Terms and Conditions (“T&C”). If you do not agree to the T&C, do not create an account, use, or access the App.

2. Eligibility and Use of the App

To ensure that the App is used safely, responsibly, and in accordance with applicable laws, all users are required to meet certain eligibility requirements and adhere to proper usage standards. This clause outlines who may access the App, the conditions under which the App may be used, and the obligations imposed on users to maintain a secure and respectful environment for all.

2.1 Eligibility

To register for access to the App and use its services, you must:

  1. Be at least 18 years of age;
  2. Be a Malaysian citizen, or if a foreigner, must hold a valid work permit, pass, or other lawful authorisation to reside or work in Malaysia;
  3. Have the legal capacity to enter into a binding agreement; and
  4. Provide accurate, current, and complete information during registration.


2.2 Proper Use of the App

When accessing or using the App, you agree to:

  1. Use the App only for lawful purposes and in accordance with applicable laws;
  2. Avoid using the App in any manner that could damage, disable, overburden, or impair its functionality;
  3. Avoid interfering with any other user’s access to or enjoyment of the App; and
  4. Comply with all restrictions described in Clause 7 (Prohibited Activities).

Certain features of the App may be governed by additional T&C. In the event of a conflict, the additional terms shall prevail.

2.3 User Obligations

By registering for access to the Site or the App and use of the Services, you agree you will:

  1. Maintain the confidentiality of your login credentials and remain responsible for all activities conducted under your account;
  2. Not impersonate any person or entity;
  3. Not submit or transmit any material that is offensive, defamatory, obscene, unlawful, harmful, threatening, abusive, harassing, or ethnically objectionable;
  4. Ensure that all information you provide remains accurate and current;
  5. Notify us immediately if you suspect unauthorised access to your account; and
  6. Use the App in accordance with these T&C and all applicable guidelines and policies.

AksesCare reserves the right to suspend or terminate any account that violates these T&C, including accounts registered by individuals below the minimum age requirement. Certain features of the App may be subject to additional T&C, which are incorporated by reference. In the event of a conflict, the additional T&C shall take precedence.

3. Content

The App may display articles, videos, wellness tips, and other materials (“Content”) for informational and educational purposes only. This Content does not constitute professional medical advice, diagnosis, treatment, or professional healthcare services. Use of the app and its Content does not create a doctor-patient, healthcare professional–patient, or other clinical relationship between you and AksesCare or any Healthcare Provider.

You should always consult a qualified healthcare provider with any questions regarding your health or medical conditions. In cases of a medical emergency, you should not rely on the App and you should immediately contact the appropriate emergency services in your area or visit the appropriate medical facility.

While efforts may be made to ensure the relevance and accuracy of the Content, use of such Content is at your own risk, and AksesCare disclaims all liability arising from any reliance placed on such materials.

It is important to note that the Content that you obtain or receive from the App, and/or its employees, contractors, partners, sponsors, advertisers, licensors or otherwise through any services rendered by the App are purely for informational, educational, scheduling and pricing purposes only.

The Content in the App may be reviewed by editorial personnel; however, we are not responsible for any errors, omissions, or outcomes resulting from its use.

4. Privacy

AksesCare respects the privacy of its users. Please refer to AksesCare’s Privacy Policy for information on how we collect, use, and safeguard personal data in compliance with the Personal Data Protection Act 2010 (PDPA).

5. Intellectual Property

All content within the App, including but not limited to text, graphics, logos, icons, images, software and interface design, is the property of AksesCare or its licensors and is protected by applicable intellectual property laws.

This licence is limited in nature and is granted solely for your personal, non-commercial use of the App in accordance with these T&C provided. Except as expressly provided, you are not granted any other rights or licences to any intellectual property owned or controlled by AksesCare or its licensors or affiliates.

You may not reproduce, distribute, modify, display or create derivative works from any part of the App or its content without prior written consent of AksesCare, unless expressly permitted by law.

6. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, secure, error-free, or free of viruses or other harmful components. You agree that your use of the App is at your sole risk.

No Endorsement of Healthcare Providers: The App may provide listings, profiles, and appointment booking functionalities for third-party healthcare providers (“Healthcare Providers”). While the App may list or suggest Healthcare Providers, we do not endorse or recommend any specific provider, nor do we guarantee the quality of services offered.

No Warranty of Third-Party Service Providers or Third-Party Site(s): Where the App integrates with third-party service providers or third-party sites, such third-parties operate independently and are not under the control, direction, or responsibility of AksesCare. AksesCare does not warrant, endorse, or assume any liability or responsibility for any acts, omissions, errors, representations, warranties, breaches, or negligence of any such third-party providers or third-party sites, or for any loss, damage, claim, or expense arising out of or in connection with their services. Your use of any third-party services is at your own risk, and may be subject to such third-party’s own terms of use, privacy policy, and other applicable conditions.

7. Account Registration and Security

To gain full access to the App, you must register by creating a username and password (“Registration Details”). You agree to provide accurate and complete information during registration and to keep your login credentials secure.

You are responsible for maintaining the security of your Registration Details and you must notify us immediately if you suspect any unauthorised access to your account or your password has been lost, stolen or compromised by contacting us at +6011-5751 3160.

By registering, you warrant that you are legally authorised to use the App in your jurisdiction. The App is based in Malaysia; users outside Malaysia access the App at their own risk and are responsible for compliance with local laws.

8. Prohibited Activities

The following is a non-exhaustive list of prohibited activities which you shall not engage in with respect to the App. We reserve the right to amend this list at any time:

  • Violate any applicable laws or regulations in Malaysia;
  • Transmit any offensive, defamatory, or illegal content;
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity in connection with the App;
  • Express or imply that any statements you make are endorsed by AksesCare without our prior written consent;
  • Reverse-engineer or hack the App;
  • Use automated tools (e.g., bots or scrapers) without permission;
  • Upload viruses or malicious code;
  • Use the App or its content for illegal, fraudulent or harmful purposes;
  • Publicly disclose or disseminate information regarding the performance of the App, or use the App for commercial exploitation;
  • Retrieve, solicit, or collect information of other users for any reason whatsoever, including, without limitation, to send unsolicited communications;
  • Use the App including any payment and/or fund-transfer features, for any unlawful financial activities, including but not limited to money laundering, terrorist financing, proceeds of crime or unlicensed money services in contravention of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA), or any other applicable laws and regulations in Malaysia;
  • Harmful content, which includes among others:
    • Child Sexual Abuse Material (“CSAM”);
    • Non-consensual sharing of intimate content;
    • Content related to online financial scams such as phishing, romance scams, investment scams, and other deceptive schemes;
    • Content that is used to bully;
    • Content that can incite violence, extremism and/or terrorism;
    • Content that is likely to induce a child to cause physical and/or psychological harm to themselves;
    • Content that incites hate speech;
    • Content related to the sale of illegal drugs; and
    • Manipulated media, such as deepfakes and/or doctored images that can cause harm to individuals or society.

We reserve the right to investigate violations and take appropriate legal action.

9. Limitation of Liability

To the fullest extent permitted by law, AksesCare shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or in connection with:

  1. Your access to or use of (or inability to access or use) the App;
  2. Any conduct, content, or services provided by third-party service providers integrated with the App;
  3. Unauthorised access, use, or alteration of your data or transmissions; or
  4. Any other matter relating to the App.


10. Indemnification

By using the App, you agree to indemnify, defend, and hold harmless AksesCare, its affiliates, officers, directors, employees, agents, licensors, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or in connection with:

  1. Your breach of the T&C or violation of any applicable law;
  2. Your use of the App or any services offered through third-party providers or sites, including but not limited to payment processing, consultancy, community engagement, promotional, or contest services;
  3. Your infringement or alleged infringement of any third-party rights; or
  4. Your misuse, negligence, or misconduct in connection with the App or any third-party integrations.

You will also indemnify us against any claims that information or material which you have submitted to us is in violation of any law or in breach of any third-party rights, including but not limited to claims in respect of defamation, breach of confidence, infringement of copyright or infringement of any other intellectual property rights.

11. Termination

We may suspend and/or terminate your access to the App at any time, without prior notice or liability to you, for any reason including but not limited to violation of these T&C.

If your access is suspended and/or terminated, you agree not to attempt to use access or use the App again, unless re-registration is expressly permitted such as in the case of inactivity-based deactivation. Termination of your account does not affect any rights or obligations accrued prior to the date of termination.

The obligations in Clauses 3, 6, 8, 9, and 10 shall survive any termination or expiration of these T&C.

12. Governing Law

These T&C are governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13. Amendments to Terms

We may update these T&C from time to time. Any material changes will be communicated to you through the App or other suitable means. Changes to the T&C will take effect immediately upon notification and publication of the updated T&C.

Your continued use of the App after such changes constitutes your acceptance of the revised T&C.

AksesCare may, at its own discretion, modify or discontinue any features, services, tools, directories, or content forming part of the App at any time, without prior notice and liability to you.

14. Acknowledgement and Acceptance

Your continued use of the App indicates that you have read, understood, and agreed to be bound by these T&C.

Any modifications to this agreement will be made in accordance with Clause 13.
